1. AL-KO Warranty Statement

1.1 This Product Warranty only applies to products referred to in Schedule 2 (WTD-P-003) that:

have been acquired new, directly from AL-KO, by AL-KO business customers (Customers) to use the Products or transform them:

in the course of a process of production or manufacture; or

in the course of repairing or treating other goods; and

have been acquired in Australia for use in Australia.

1.2 This Warranty applies for the sole benefit of the Customers.

1.3 This Warranty does not apply to end-customers of the AL-KO Customer and is not transferable or assignable.

1.4 This Warranty is confidential and should not be shared with or otherwise disclosed to retail customers or end-customers of the AL-KO Customer.

2. Warranty

2.1 AL-KO International Pty Ltd and AL-KO Chassis Systems Pty Ltd (Dandenong HQ ABN 96 003 066 813 and Campbellfield ABN 625 886 624) warrants that:

The Product is free from defects in design, materials or workmanship and will not break down during the Warranty Period itemised for the Product in Schedule 2 when used in strict accordance with AL-KO’s written specifications, technical data sheets, instructions and recommendations, and maintained in accordance with AL-KO’s recommended maintenance program (where required);

where AL-KO has agreed in writing to manufacture or supply the Product in conformance with a specification, the Product will conform to the Specification requested by the Customer to AL-KO; and

The product is of merchantable quality and fit for any purpose held out by AL-KO.

2.2 Subject to these terms and conditions, the Warranty continues in Australia for the Warranty Period itemised for the Product in Schedule 2.

2.3 Subject to these terms and conditions, if before the end of the applicable Warranty Period, AL-KO in its sole discretion (acting reasonably) finds the Product to be defective in design, material or workmanship, AL-KO will, in its sole discretion, either:

Replace the faulty product.

Repair the faulty product.

2.4 AL-KO reserves the right to replace defective parts of the Product with parts and components of similar quality, grade and composition where an identical part or component is unavailable. Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods

3. Warranty Terms and Exclusions - Manufacture

3.1 This warranty covers the cost of replacement or repair of the Product or Product parts which are proven to be defective in design, materials or workmanship.

3.2 To the extent permitted by law, there are no other warranties expressed or implied by AL-KO covering the Products other than this Warranty.

3.3 Notwithstanding any other provision of this Warranty, AL-KO’s liability under this warranty is limited to three times the replaceable value of the Product, or three times the market value of the Product.

3.4 To the extent permitted by law, AL-KO’s liability under this Warranty excludes all consequential or indirect damages of any kind whatsoever.

3.5 AL-KO will not be liable under this warranty if:

AL-KO cannot establish any fault in the Product after testing and inspection;

the Product defect is attributable to any of the following:

misuse, negligence or accident;

modification of the Product by any person without AL-KO’s prior authorisation;

failures by the Customer to use, install or incorporate the Product in a process of assembly or manufacture in accordance with applicable technical data sheets, instructions and specifications supplied by AL-KO, including use for a purpose other than that for which the Product was designed;
failure by the Customer to service or maintain the Products in accordance with applicable technical data sheets, instructions and specifications supplied by AL-KO;
the defect is a deterioration of the Product’s appearance (cosmetic finish or corrosion);
damage to the Product due to normal wear and tear;
a power surge or other fault in the supply of electricity concerning the Product; or
the Product’s serial number or warranty seal has been removed or defaced.

3.6 This warranty supersedes all previous warranties (if any) in respect of the Product.

3.7 This warranty becomes null, void and of no effect if:

the Product is used, mixed, associated, or assembled in concert with a third party product or part without AL-KO’s prior written authorisation;
AL-KO has not been advised in writing of a Product defect within 14 days from the discovery of an alleged manufacturing defect; or
AL-KO is not provided a reasonable opportunity to inspect and test the defective Product, and assess damages resulting from the manufacturing defect in the Product.
